A court in Illinois has sent a message this month that the violations of the asbestos, which put the public at risk will not be tolerated.
A court in central Illinois has sentenced a man in Auburn, Illinois, 1 ½ years of probation, followed by three months in jail and 100 hours of community service for dangerous and improper handling of carcinogenic material in a draft construction.
Meanwhile, the ministry ordered the defendant and his wife received a $ 75,000 fine plus court costs.
As part of his sentence, Ray F. Landers also publish an apology to the citizens of Virden, Illinois, for not adequately protecting during renovation work at a nursing home by his former organization, equipping the Saints Ministry International Inc.
Asbestos is a heat and fire resistant material long associated with diseases like lung cancer and mesothelioma, a cancer of the protective lining that covers many internal organs. It’s more dangerous when the air, a special concern in the renovation and demolition, because asbestos fibers are dislodged and released into the air can be inhaled, causing mesothelioma and other diseases.
Because these conditions can develop years after exposure, mesothelioma lawyers say Landers violations can give rise to such claims for asbestos and many years of death on the road.
Landers, 57, was also fined $ 2,500 and ordered to pay another $ 2,500 in restitution to allow the Environmental Protection Agency Illinois and Inspection Fund.
The original of the Illinois EPA began its investigation into the incident after learning that Landers has been renovating the former Virden Nursing Home, but authorities did not properly inspected to determine if materials containing asbestos or asbestos has been properly removed. Landers has also failed to notify the Illinois EPA of asbestos, as required by Illinois law.
Landers and the Department have been indicted in 2007 on eight counts. Ultimately, the department pleaded guilty to improper disposal of asbestos, while Landers pleaded guilty to a misdemeanor, the non-declaration of demolition or renovation. The other charges were dropped.
Illinois EPA Daniel Merriman, who prosecuted the case of Colette Illinois Attorney General Kennedy said the hope is that the sentence that goes beyond monetary penalties lead others to do the right thing. In the case of asbestos, which is to take the necessary measures to protect the community against the risks of asbestos-related diseases such as mesothelioma, who always wears a dark diagnosis.
Over the years, mesothelioma lawyers have succeeded far more than medical researchers, winning compensation for the many victims of deadly diseases caused by exposure to asbestos.
“It was a fair sentence to reflect the seriousness of the offense, the risk has been established, and the potential risk to the neighbors and the community,” said Merriman. “People tend not to take the asbestos problem seriously.”
